Fireworks are legal in unincorporated El Paso County, but the Commissioners Court may ban skyrockets-with-sticks and missiles-with-fins during drought. Cities of El Paso, Socorro, Horizon City and San Elizario ban fireworks entirely.
Texas permits consumer fireworks in unincorporated county areas outside city limits. Under Texas Local Government Code Sec. 352.051, when the Texas A&M Forest Service finds a Keetch-Byram Drought Index of 575 or greater, the El Paso County Commissioners Court may by order prohibit the sale or use of 'restricted fireworks' (skyrockets with sticks and missiles with fins) in the unincorporated area. In June 2025 the Court adopted such an order; in 2026 the drought threshold was not met, so no restriction was imposed. State law separately bans discharge within 600 feet of hospitals, schools or licensed child-care centers. Verify each year's order before buying.
Violating a Commissioners Court fireworks order is a Class C misdemeanor under Sec. 352.051, punishable by a fine up to $500. Discharging fireworks inside a city that bans them is a separate municipal offense.
