Tulsa County has not enacted a county-wide ordinance banning consumer fireworks in unincorporated areas, so the Oklahoma Fireworks Act (68 O.S. Β§Β§1621-1635) controls β meaning the same Class C consumer fireworks sold at the seasonal stands ringing Tulsa, Bixby and Jenks are legal to discharge on private property in unincorporated Tulsa County. Cities such as Tulsa, Owasso and Jenks ban discharge inside their corporate limits, which is the legal driver pushing residents to county land each Fourth of July.
Under 68 O.S. Β§1623, fireworks classified as 1.4G consumer fireworks may be sold by licensed retailers from June 15 through July 6 and again from December 15 through January 2, and use on private property is permitted statewide unless a local government has enacted a more restrictive ordinance. The state statute prohibits skyrockets with sticks (68 O.S. Β§1624) and bans use of any fireworks within 500 feet of a fireworks stand, on public property, or in a vehicle. Tulsa County Sheriff's deputies enforce the state act on county land along with any reckless conduct that endangers others. Property owners remain liable under common-law nuisance and Oklahoma's reckless burning statute (21 O.S. Β§1761) if a discharge causes fire damage to a neighbor's property.
Violations of the state Fireworks Act are misdemeanors under 68 O.S. Β§1633 punishable by a fine up to $500 plus seizure of the fireworks. Reckless burning under 21 O.S. Β§1761 escalates to a felony if structural damage results. The county does not maintain a fireworks permit program for personal use.
