Ohio Revised Code Chapter 3743 governs fireworks statewide, licensing manufacturers and wholesalers and setting baseline rules for consumer fireworks discharge on designated holidays unless a political subdivision opts out.
Under ORC 3743.65, individuals 18 or older may discharge 1.4G consumer fireworks on private property or with permission on specified holidays including July 3, 4, 5, Labor Day weekend, Diwali, New Year's Eve, and Chinese New Year. Possession and use must comply with manufacturer instructions, and discharge while intoxicated is prohibited. Municipalities and townships may pass ordinances banning or further restricting discharge under ORC 3743.75, but baseline licensing of manufacturers, wholesalers, and retailers is exclusively a state function regulated by the State Fire Marshal.
First-degree misdemeanor for unlicensed sale; minor misdemeanor for unlawful discharge; up to $1,000 fine and 180 days jail.
