Unlike many wildfire-prone California counties, unincorporated Colusa County ALLOWS state-approved 'safe and sane' fireworks. County Code Chapter 7 (Fire Prevention) permits sale only from temporary stands run by qualified local nonprofits with a fire district permit. Sales run noon June 28 through midnight July 5, and discharge is legal only during that window. 'Dangerous' fireworks remain banned statewide.
Colusa County's fireworks rules are set in its County Code, Chapter 7 'Fire Prevention,' which adds fireworks sections (Sec. 12.107 through 12.115) to the adopted Uniform Fire Code. Section 12.108 permits the retail sale of fireworks 'as are defined and classified as "safe and sane fireworks" by Section 12504 of the Health and Safety Code,' within the unincorporated area. A fire district permit is required (Sec. 12.109), and under Section 12.110 permits are issued only to nonprofit organizations organized for veterans, patriotic, welfare, educational, civic-betterment or charitable purposes that have had their principal meeting place in the county for at least one continuous year and have at least 15 bona fide members. Sales must be from a temporary stand only (Sec. 12.113); stands cannot be within 25 feet of any building or 50 feet of a gas station, and must keep weeds and combustible material cleared at least 25 feet around. Section 12.115 fixes the legal window: sales may not begin before 12:00 noon on June 28 and may not continue after 12:00 midnight on July 5, and 'Discharge of fireworks shall only be legal during the periods fireworks may be sold.' Stands must be removed and litter cleared by noon July 10. Statewide, 'dangerous' fireworks (firecrackers, bottle rockets, sky rockets) remain illegal under California Health & Safety Code 12500 et seq.
Violation of the adopted fire code provisions is a misdemeanor under County Code Sec. 7-7, punishable by a fine of not less than $25 and not more than $500, or by imprisonment, with each ten days a prohibited condition continues a separate offense. Possessing or using 'dangerous' fireworks is separately illegal statewide under Health & Safety Code 12500 et seq. Anyone whose fireworks start a fire can be billed for suppression and damage costs.
