NYC and Nassau County opted out, keeping all fireworks and sparklers illegal. In Manhattan, all consumer fireworks including sparklers are banned. Professional displays require FDNY permits. Illegal fireworks are a major enforcement issue, especially around July 4th. NYPD and FDNY conduct joint enforcement operations.
Possession of fireworks: Class B misdemeanor, up to 3 months jail and $500. Dangerous fireworks: Class A misdemeanor, up to 1 year. FDNY seizure.
