Smoke alarm requirements in Santa Barbara follow California law. State Health and Safety Code Sections 13113.7 and 13113.8 require State Fire Marshal-listed smoke alarms in every dwelling and an operable alarm in every single-family home that is sold, with a written compliance statement to the buyer.
The City of Santa Barbara adopts the California Fire Code and California Residential Code through Municipal Code Chapter 8.04 and its building code, so smoke alarm requirements largely flow from statewide standards rather than a unique city ordinance. Under California Health and Safety Code Section 13113.7, smoke alarms approved and listed by the State Fire Marshal must be installed, per the manufacturer's instructions, in each dwelling intended for human occupancy; owners of rental dwellings were required to bring units up to current building-standard placement. Under Health and Safety Code Section 13113.8, every single-family dwelling and factory-built home that is sold must have an operable, State Fire Marshal-listed smoke alarm, and the seller (transferor) must deliver to the buyer a written statement certifying compliance before transfer of title. The California Residential Code (Section R314) and Building Code set placement rules for new construction and major alterations - generally in each sleeping room, outside each sleeping area, and on every level - which the city enforces through building permits. The City's adopted Fire Code (Section 907, as amended) adds a fire-alarm and notification requirement for mixed-use buildings combining residential and commercial occupancies. Santa Barbara also separately requires carbon monoxide alarms in dwellings with fuel-burning appliances or attached garages under state law.
Smoke alarm violations are enforced through state law and the city's adopted building and fire codes; non-compliance at sale can expose a seller to liability under Health and Safety Code Section 13113.8, and code violations are misdemeanors under Municipal Code Section 8.04.020.
