Senate Bill 762 (2021), codified at ORS 477.490 and related sections, requires Oregon Department of Forestry and Oregon State University to develop and maintain a statewide wildfire hazard map classifying every tax lot as low, moderate, or high hazard within the wildland-urban interface. Properties designated high hazard within the WUI become subject to statewide defensible space standards under ORS 477.046 and to building code home-hardening requirements adopted under ORS 455.612 by the Building Codes Division. The Oregon State Fire Marshal administers defensible space rules. The map and resulting requirements apply uniformly statewide.
Failure to maintain required defensible space within designated hazard zones may result in state-imposed corrective action and cost recovery under ORS 477.062, plus potential liability for fire suppression and damages.
