Texas authorizes License to Carry (LTC) holders to carry concealed handguns statewide under Government Code Chapter 411. Since 2021, permitless constitutional carry under HB 1927 also allows most adults 21 and older to carry without a license, with municipalities preempted from added restrictions.
Government Code Chapter 411, Subchapter H establishes the Texas License to Carry program administered by DPS. HB 1927 (2021), codified in Penal Code 46.02, created permitless carry for adults 21+ not otherwise prohibited from possessing firearms. Local Government Code 229.001 prevents municipalities from imposing additional concealed carry restrictions, training requirements, or fees. Statutory off-limits locations under Penal Code 46.03 and 46.035 (schools, polling places, courts, secured airport areas, bars where 51% revenue is alcohol) apply uniformly statewide. Property owners retain rights to post 30.06/30.07 signs prohibiting carry on private premises.
Carrying in prohibited locations is generally a Class A misdemeanor under Penal Code 46.03; trespass after 30.06/30.07 notice is a Class C escalating to Class A on refusal to leave.
