A yard sale in Fayetteville requires a permit from the city inspection department before it opens. The applicant files a written statement, pays a fee set by city council, and posts the permit where the public can see it.
Section 15-34 bars any yard sale until the organizers obtain a permit from the inspection department. The written statement filed beforehand lists the applicant's full name and address, the sale location, the date of the sale, and an affirmative statement that the goods are the applicant's own personal property, neither acquired nor consigned for resale. An administrative processing fee applies under the fee schedule adopted by city council. The inspection department can investigate before issuing, and it can revoke a permit or refuse an application containing false, fraudulent, or misleading statements. Section 7-62 lists yard sales among the permits the inspection department issues.
Misdemeanor. Police officers and designated inspectors have right of entry to any premises showing evidence of a yard sale, and can close the sale or arrest violators.
