Elgin Municipal Code Chapter 9.36 (Garage and Yard Sales) regulates residential sales of used household goods. EMC Β§9.36.020 limits each household to a maximum of two garage sales per calendar year, each lasting no more than three consecutive days. Sale hours are 7 AM to sunset only β no nighttime sales. Signs advertising the sale must be limited to 4 square feet, posted no more than 48 hours before the sale, and removed within 24 hours after. Sales must be conducted on private residential property; sales in the public right-of-way are prohibited. No license is required for sales within the 3-day/2-per-year limits. Sales of new merchandise, professionally stocked goods, or commercial resellers are not considered garage sales and require a separate business license. Illinois home rule authority under Art.
