040, titled 'Fence installation,' states plainly that a building permit is required prior to the construction or installation of any fence within the city, and that fences must be constructed or installed according to the regulations established in Title 19 of the Elgin Municipal Code (the zoning title). 04 alongside the city's other building-code administrative requirements, which were re-enacted under Ordinance No. G13-25 on March 26, 2025. Because the permit requirement is untethered to fence height, material or location, it applies to a chain-link fence around a small backyard exactly as it applies to a large commercial screening fence; the only question the ordinance leaves to Title 19 is what the fence may look like once a permit is sought.

The community development department's building division reviews and issues fence permits, checking the proposed fence against the zoning-title placement and construction standards before work can start. 20 of the city Code. 4 makes continuing that work a separate, additional violation subject to its own fine.
