No driver or owner of any motor vehicle within the city shall operate or permit operation of any sound-amplification device or system which can be heard outside the vehicle from seventy-five (75) or more feet when the vehicle is being operated upon a street, highway or roadway unless such device or system is being operated to request assistance or warn of a hazardous situation. This section does not apply to authorized emergency vehicles. This section also does not apply to vehicles when the same are operated pursuant to and in conformance with a sound-amplifying device permit pursuant to chapter 10.28, as amended, and a special event permit pursuant to chapter 13.25, as amended. Any person, firm or corporation, who violates any provision of this section shall, upon conviction thereof, be punished by a fine in the amount of one hundred dollars ($100.00) for a first offense, two hundred fifty dollars ($250.00) for a second offense and five hundred dollars ($500.00) for a third and any subsequent offense.
