Under the Alaska Uniform Common Interest Ownership Act, associations may adopt and enforce architectural standards through the declaration and rules. Architectural Review Committees (ARCs) typically require written applications for exterior changes such as paint colors, fences, sheds, decks, solar panels, and landscaping. AS 34.08.590 requires rules to be reasonable and enforced in good faith. Approval or denial should be provided in writing within the time frame established in governing documents, often 30 to 60 days. Denials should cite specific standards and allow owners to appeal to the full board. Courts will set aside ARC decisions that are arbitrary, discriminatory, or inconsistent with prior approvals. Anchorage zoning still applies regardless of ARC approval; an ARC cannot waive building permit requirements. Solar energy devices enjoy some protection but Alaska has no statewide solar-rights statute as of the 2026 reference.
