Ohio HOA architectural review is governed by recorded declarations and ORC 5312.11. Associations may require owner approval before exterior modifications (paint, fences, additions, landscaping). ORC 5312.11(C) requires architectural standards to be reasonable, uniformly enforced, and adopted with notice to owners.
Under ORC 5312.11 associations adopt architectural standards through their declarations or duly adopted rules. Standards must be enforceable uniformly and cannot discriminate arbitrarily. Owners typically submit Architectural Review Committee (ARC) applications with plans, materials, and color specifications. Response time varies by declaration; 30-60 days is common. Ohio's solar access statute (ORC 303.213) limits HOA restrictions on solar collectors in certain circumstances. Federal law (OTARD rule) preempts HOA restrictions on satellite dishes under 1 meter.
Unauthorized modification: HOA may require removal at owner expense plus fines under declaration. Owner may contest in common pleas court.
