Ohio Planned Community Law under ORC 5312.03 authorizes HOAs to enforce architectural controls contained in the declaration recorded against the property. Common review items include paint colors, roofing materials, fences, sheds, additions, pools, and landscaping changes. HOAs must follow the review timeline stated in their governing documents, commonly 30 to 60 days, and cannot act arbitrarily or discriminatorily under ORC 5312.03(C). If the HOA fails to respond within its stated deadline, approval is often deemed granted per declaration terms. City building permits still apply regardless of HOA approval. Disputes go to Common Pleas Court; Ohio has no HOA ombudsman.
