Parma HOAs may levy assessments per ORC 5312.11 and record liens for unpaid dues under ORC 5312.12. Liens have priority over most subsequent interests and can lead to foreclosure.
Ohio Planned Community Law grants HOAs statutory lien rights for unpaid assessments, fines, and attorney fees. Under ORC 5312.12, an unpaid assessment becomes a lien against the lot 90 days after becoming due, and the HOA may record a certificate of lien in Cuyahoga County. Liens can be enforced by foreclosure in Common Pleas Court. HOAs must follow any notice and cure provisions in the declaration before recording. Special assessments generally require owner approval per the declaration. Parma municipal code does not preempt or modify these state rights. Owners who dispute assessments must still pay under protest to avoid lien escalation.
