Ohio has no state HOA ombudsman. Parma HOA disputes are resolved through internal HOA procedures first, then Cuyahoga County Common Pleas Court. Mediation is encouraged but not mandatory under ORC 5312.
Unlike Florida or Nevada, Ohio does not have a state agency that regulates or adjudicates HOA disputes. Owners must first exhaust internal HOA dispute procedures specified in the governing documents. If unresolved, owners may file suit in Cuyahoga County Common Pleas Court. ORC 5312.04 requires HOAs to act in good faith and prohibits arbitrary, capricious, or discriminatory enforcement. Small claims court (up to 6,000 dollars) is available for smaller disputes. Many HOA declarations include mandatory mediation or arbitration clauses, which courts generally enforce. Attorney fees are often recoverable by the prevailing party per the declaration.
