Nevada HOA disputes go through the Nevada Real Estate Division Ombudsman and the Commission for Common-Interest Communities. Alternative dispute resolution is required before most civil lawsuits under NRS 38.310.
Reno HOA owners who have disputes with their association can file complaints with the Nevada Real Estate Division (NRED) Ombudsman for Common-Interest Communities, created under NRS 116.625. The Commission for Common-Interest Communities and Condominium Hotels has enforcement authority, including fines on board members and associations. NRS 38.310 requires most civil claims between owners and HOAs to go through alternative dispute resolution (mediation or arbitration) before filing in district court. Claims involving foreclosure, title, or injunctive relief may proceed directly to court. NRED-administered ADR is typically less expensive than civil litigation.
