Under NRS 116.31031, a fine for a violation 'must not exceed $100 for each violation or a total amount of $1,000, whichever is less.' But if the violation 'poses an imminent threat of causing a substantial adverse effect on the health, safety or welfare' of owners or residents, the fine must instead be commensurate with the severity and set by the board under its governing documents, escaping the $1,000 cap. Before fining, the board must give written notice and a reasonable opportunity to cure or to contest the violation at a hearing. If a fine is imposed and the violation is not cured within 14 days, it becomes a 'continuing violation' subject to additional fines.
