ADU rules in Paradise, NV β also called accessory dwelling unit regulations or granny flat ordinances β cover setbacks, owner-occupancy, parking, and permit requirements.
Unincorporated Clark County regulates Accessory Dwelling Units (ADUs, locally called Accessory Apartments) under Title 30 (Unified Development Code). Recent code amendments have eliminated the minimum lot size requirement, removed the one-bedroom cap, and now explicitly allow basement ADUs. ADUs are permitted in the R-U, R-A, R-E, R-D, R-1, R-T, R-2, H-2, and H-1 zoning districts.
Clark County Title 30 defines an Accessory Apartment as a segregated portion of a dwelling, or a separate habitable structure on a lot with a dwelling, used for residential purposes including kitchen and bathroom facilities. It is not counted toward density when calculating units per acre. After the 2023-2024 code update, the minimum lot size requirement for an accessory apartment was removed (lots still need to meet setback and coverage rules), the previous one-bedroom limit was eliminated, and basement ADUs are now permitted. Attached ADUs may cover up to 50% of the primary dwelling's floor area; attached and detached ADUs are generally capped at 1,200 sq ft. Setbacks follow the underlying zoning district. Because Nevada has no statewide ADU mandate like California's Gov Code Β§65852.2, Clark County retains discretion on parking, owner-occupancy, and rental rules. Building permits are issued by the Clark County Department of Building & Fire Prevention and must meet the 2018 International Residential Code as locally amended.
Unpermitted accessory apartments in unincorporated Clark County are violations of Title 30 enforced by the Clark County Department of Comprehensive Planning and Code Enforcement, with stop-work orders, daily-accruing administrative fines, and required after-the-fact permits or removal. Failure to obtain a Special Use Permit where required is separately citable.
