'Class B' CFOs (direct + indirect sales, up to $150,000) require a permit and inspection. Under HSC §51035 and the Homemade Food Act, CFOs are deemed a residential use and a city cannot prohibit them, but local zoning standards on use, parking, noise, traffic, and signs still apply. In El Monte that means CFO operators must also obtain a Business Occupancy Permit and comply with EMMC §17.110.050: 500 sq ft cap, no on-site signs, appointment-only sales 7 a.m.-10 p.m. Monday-Saturday, and no prohibited activities. An operator must complete an approved food processor course within three months of registration (HSC §114365).
Operating a CFO without state registration/permit is a violation of HSC §114365 and may result in cease-and-desist orders and fines from LA County Public Health. Violating El Monte's home occupation standards (no BOP, on-site sign, over 500 sq ft, walk-in customers) carries administrative citations of $100/$200/$500 under EMMC Chapter 1.24.
