Under La. R.S. 40:4.9, low-risk foods include baked goods (breads, cakes, cookies, pies), candies, cane syrup, dried mixes, honey and honeycomb products, jams/jellies/preserves, pickles and acidified foods, sauces and syrups, and spices. The seller must affix a label stating the food was not produced in a licensed or regulated facility (except raw honey). Bakery items (breads, cakes, cookies, pies) may be sold only directly to the end consumer, not to a retailer for resale. The exemption ends once gross annual sales reach $30,000. Commercial catering must use an off-site commercial kitchen.
Selling non-listed or animal-protein foods, mislabeling, wholesaling bakery items, or exceeding the sales cap removes the exemption and requires standard commercial food licensing under state law.
