Act 106 (3 Pa.C.S. Ch. 57) amended PAs Limited Food Establishment rules to allow cottage food producers to sell shelf-stable, non-time/temperature-controlled items from home kitchens. Products must be labeled with producer name, address, ingredients, allergens, and a Made in a home kitchen disclosure. Sales permitted direct to consumer at farmers markets, home, events, and online with in-person pickup or delivery; no wholesale or out-of-state mail order. PA Department of Agriculture registration (around $35) and a food safety course are required. In Allegheny County, ACHD may inspect on complaint. Home occupation zoning rules still apply to the commercial activity.
