Pennsylvania's Limited Food Establishment program (3 P.S. §5721) allows home-based food production with PA Department of Agriculture registration. Bucks County cottage food operators must register and follow labeling and sales requirements.
Pennsylvania operates under a Limited Food Establishment program administered by the PA Department of Agriculture, Bureau of Food Safety (3 P.S. §5721 et seq.). Home food producers must register with PDA (approximately $35 annually) and pass an initial inspection. Permitted products include non-potentially hazardous foods: baked goods without cream filling, jams and jellies using approved recipes, dry goods, candy, honey, and popcorn. Potentially hazardous foods requiring refrigeration (cheesecake, cream pies, meat, fish) are not permitted. PA does not cap total revenue under Limited Food Establishment (unlike some states' cottage food laws). Labels must include product name, ingredients in descending order by weight, allergen disclosure, net weight, producer name/address, and the phrase "Made in a home kitchen that has not been subject to Pennsylvania's food safety regulations." Sales may be made direct to consumer, at farmers markets, and retail (including wholesale under some conditions).
Operating without PDA registration: cease and desist and fines up to $1,000 per offense. Selling non-permitted foods: seizure and injunction. Labeling violations: warnings then citations up to $500.
