To run a business from a Baldwin Park home you must obtain a Home Occupation Permit from the City's Business License Department (BPMC 153.120.260), in addition to any other required licenses. You sign an affidavit agreeing to the conditions in BPMC 153.120.270; violating them makes the operation illegal and it must cease.
In the City of Baldwin Park, a home-based business is established through a Home Occupation Permit. BPMC 153.120.260 provides that 'To establish a home occupation, a home occupation permit shall be obtained from the Business License Department, in addition to all other required licenses and permits.' The City's one-page application captures the applicant and business name, address and the specific use of the business, and lists the seven conditions of approval drawn from BPMC 153.120.270.A.1-6 (and the signage limit): (1) no display or storage of goods, wares, merchandise or stock in trade on the premises; (2) no one other than persons residing on the lot regularly employed in the occupation; (3) no equipment emitting dust, fumes, noise or odor that would interfere with adjacent properties, and no commercial vehicles greater than 3/4-ton capacity; (4) not more than 150 square feet of the dwelling's floor space devoted to the use; (5) no appreciable increase in pedestrian or vehicular traffic; (6) no structural alteration of any building or structure; and (7) no use of any sign not otherwise permitted in the zone. The applicant signs an affidavit certifying the home occupation 'will be conducted in conformity with all of the above conditions' and acknowledging that if the operation does not comply 'my operation will become illegal and must cease.' The permit is reviewed and may be approved, approved with conditions, or denied. Because this is the City's permit process, it operates in addition to - and cannot override - state mandates such as the family day care and cottage food laws.
Running a home occupation without the permit, or breaching its conditions, renders the operation illegal under the signed affidavit and subject to an order to cease, plus Code Enforcement action. Apply for and ask questions about the Home Occupation Permit through the City's Business License/Finance counter; the Planning Division at (626) 813-5261 can confirm zoning compliance.
