Lodi requires a Home Occupation Permit for any business operated from a residence under LMC 17.36.060. The home occupation must remain secondary to the residential use, with no employees coming to the home, no signage, and no customer traffic that disrupts the neighborhood.
Under LMC 17.36.060 (Home Occupations), a Home Occupation Permit application must be submitted to Lodi Planning Division along with the application fee. The home occupation must be clearly incidental to the residential use, conducted entirely within the dwelling (except where state law permits otherwise, such as small home daycare and cottage food operations), with no exterior evidence of the business other than that allowed by state law. No non-resident employees may report to the home, on-street parking demand cannot exceed what is typical for the residence, and outdoor storage of business equipment or materials is prohibited. The permit is also the path used by short-term rental operators in Lodi today, which currently costs about $100, in addition to the city's transient occupancy tax obligation.
Operating a home business without a Home Occupation Permit, or violating the permit conditions, is a zoning violation enforced by Community Improvement under LMC Title 17 with administrative citations.
