Under LMC Title 15, which adopts the California Residential Code and California Fire Code by reference, smoke alarms are required in each sleeping room, in the hallway outside sleeping rooms, and on each story including basements. New construction and substantial alterations requiring a permit must install hard-wired, interconnected 120V alarms with battery backup. Existing dwellings sold or altered must be retrofitted to current standards before final inspection. California Health & Safety Code Β§13113.7 and Β§13113.8 require all single-family and multi-family dwellings to have working smoke alarms regardless of permit history. Carbon monoxide alarms are required by Cal. H&S Β§17926 in any dwelling with a fuel-burning heater, fireplace, or attached garage.
Failure to provide working smoke or CO alarms is a Health & Safety Code violation that can be cited by Lodi Fire and Code Enforcement. Landlords face additional civil liability for failing to maintain alarms.
