In unincorporated Adams County, a home occupation must be conducted by the inhabitants of the dwelling, use no more than half the floor area, stay entirely indoors, and produce no impacts noticeable beyond the property line.
Section 4-03-03-02-07 of the Development Standards and Regulations sets the home-occupation performance standards. The business must be run by the people living in the home; no more than one-half the dwelling's floor area may be used; all activity must occur inside the dwelling, garage, or an accessory building; there may be only incidental on-premises sales; no exterior storage of business material or equipment; and no commercial vehicle over 7,000 lbs GVW may be kept on site. Examples of permitted home occupations include art studios, professional offices, dressmaking, and teaching. Restaurants, animal hospitals, and long-term care facilities are not home occupations.
A home occupation that exceeds these standards loses its accessory-use status and becomes an unpermitted commercial use, subject to abatement and enforcement under the Development Standards and Regulations.
