Denton County, TX Home Business: Zoning Restrictions (2026)

Texas is one of the few states where counties have no zoning authority whatsoever. The Texas Local Government Code does not grant counties the power to adopt zoning ordinances, land use plans, or use-based restrictions. Denton County therefore cannot regulate home businesses through zoning. In unincorporated Denton County, a property owner may operate a business from their home without a county business permit, zoning variance, or conditional use permit. This applies to all types of home businesses including offices, workshops, studios, and online businesses. The only county-level restrictions that may apply are fire code compliance (for businesses storing hazardous materials), septic system capacity (for businesses generating additional wastewater), and on-site sewage facility permits through Denton County Development Services. HOA deed restrictions in subdivisions frequently restrict commercial activity and home businesses, and these are enforceable through civil courts.
