The City of Live Oak enforces a maximum grass and weed height of 12 inches as part of its nuisance vegetation ordinance in Chapter 7 (Health and Sanitation) of the Code of Ordinances. The rule applies to occupied residences, vacant lots, and commercial property alike. Grass, weeds, and rank vegetation that exceed 12 inches are presumed a nuisance that can harbor vermin, pests, and snakes and create a fire hazard. Enforcement is complaint-driven and proactive through Code Enforcement officers. Property owners receive a written notice of violation identifying the condition and a compliance deadline, usually 7 to 10 days. If the owner fails to abate, the city may enter the property, mow it, and assess the cost plus an administrative fee as a lien against the property under Texas Health and Safety Code Section 342.007. Xeriscape and naturalized native-plant yards are allowed but the 12-inch rule still applies unless the yard has been registered or designed as a naturalized landscape with the city.
Failure to cure after notice results in city mowing plus administrative fee and lien. Municipal Court citations carry fines up to 500 dollars per day, each day a separate offense under TX H&S 342.008.
