Brazoria County has no landscaping rule requiring or banning native plants. Texas law protects drought-resistant and xeriscape landscaping from HOA bans, and the state encourages native, water-wise plantings across the Gulf coast.
Because Texas counties cannot zone, Brazoria County does not dictate what plants you grow in unincorporated areas. Native and drought-tolerant landscaping is encouraged statewide for water conservation. Texas Property Code Section 202.007 bars a homeowners' association from prohibiting drought-resistant landscaping or water-conserving natural turf, so long as the design is otherwise reasonable; the HOA may still require a plan that preserves neighborhood aesthetics. The Texas Water Development Board and city programs such as Pearland's 'Right Tree Right Place' promote native, low-water species suited to the region's clay soils and hurricane climate.
No county penalty. An HOA cannot flatly ban drought-resistant or xeriscape landscaping; a provision doing so is unenforceable under Property Code 202.007.
