The county cannot enact its own weed ordinance, so it relies on Health and Safety Code Chapter 343 for unincorporated areas. Section 343.011 applies only to the unincorporated area of a county and lists as a public nuisance allowing weeds to grow within 300 feet of another residence or commercial establishment, and keeping rubbish within 300 feet of a public street for 10 days or more unless enclosed. Section 343.022 requires written notice describing the condition and giving until the 31st day, or the 10th business day for a repeat offense, to abate. County code enforcement handles complaints; unresolved cases go to the County Attorney, whose environmental unit also prosecutes illegal dumping.
If the owner does not abate after notice, the nuisance is a misdemeanor punishable by a fine of 50 to 200 dollars. The county may also abate and assess disposal costs plus an administrative fee of up to 100 dollars.
