Nebraska's Noxious Weed Control Act statutorily requires every landowner to control state-listed noxious weeds. Counties act as control authorities, while cities and villages must also provide for weed control within their jurisdictions under uniform statewide standards.
Under Neb. Rev. Stat. sections 2-945.01 through 2-970, the Nebraska Department of Agriculture designates noxious weeds and every owner of land statewide must effectively control them on their property. County weed control authorities (the county weed district board or county board) inspect, issue notices, and may force-control non-compliant properties at the owner's expense. Nebraska Revised Statute 2-946.02 directs all cities and villages to provide for noxious weed control within their jurisdictions. Local authorities may adopt complementary ordinances and enter cooperative enforcement agreements, but cannot exempt landowners from the statewide duty.
Failure to control after written notice allows the control authority to enter, treat the property, and assess all costs as a special assessment or lien against the land.
