LMC § 10.20.110 caps noise at 75 dB(A) in industrial zones day or night, measured at least 25 feet from the source. Industrial operations including railroad rights-of-way must keep noise below this ceiling regardless of time of day.
Under LMC § 10.20.110, industrial premises are subject to a 75 dB(A) maximum sound level measured at least 25 feet from the source — the same limit applies in both Table 10.20.110 A (nighttime, 10 p.m.–7 a.m.) and Table 10.20.110 B (daytime, 7 a.m.–10 p.m.). LMC § 10.20.110(F)(3) defines 'Industrial' as 'an area in which commodities are manufactured, processed or fabricated, and shall conditionally include railroad rights-of-way.' Under subsection (E), when a noise source can be measured from more than one zone, the permissible sound level of the more restrictive zone applies — so an industrial operation near residential property is held to the 50 dB(A) night / 55 dB(A) day residential limit at the receiving property line. § 10.20.110(D)(1) further requires that refuse-collection and compacting equipment within 500 feet of a residential zone meet the residential limit at 50 feet, with no refuse collection between 7:00 p.m. and 7:00 a.m. Truck or rail loading within 250 feet of a residential lot is banned 10:00 p.m.–7:00 a.m. per § 10.20.110(D)(2) (retail grocery loading excepted).
General municipal penalty: up to $999 fine and/or 180 days jail per violation. Temporary hardship permits (max 90 days) may be sought from the city manager.
