Per LMC § 15.04.050(D)(4), Longmont food trucks may operate only in non-residential zoning districts (ice cream vendors are allowed in residential zones), must remain at least 250 feet from any brick-and-mortar restaurant, and may not operate in city parks while park concessionaires are operating. Operating outside these zones violates the city's Land Development Code.
Longmont's mobile food vending location rules are set in LMC § 15.04.050(D)(4) of the Land Development Code: (1) Mobile retail food vending is permitted only in non-residential zoning districts. (2) Exception: ice cream vendors (mobile sales of ice cream and similar treats) are permitted to operate in residential zoning districts under standard route-vendor rules. (3) All mobile vendors must maintain a minimum distance of 250 feet from any brick-and-mortar restaurant to protect established food-service businesses. (4) Mobile vendors may not operate in city parks at times when park concessions are in operation; vending in parks generally requires separate authorization from the Parks Department because parks are city property. (5) Operators must have permission of the underlying property owner if vending on private property. (6) Public right-of-way vending is restricted; the city does not designate specific 'food truck corrals' but private-property hosts (commercial parking lots, breweries, business parks, special events) are the principal allowable locations. Special events use a separate event permit. The Boulder County Public Health license, Longmont business and sales-tax licenses, and the Mobile Retail Food Vending Permit must all be in place before locating at any approved site. Site violations trigger the civil-penalty schedule of $100 / $200 / $500 and may jeopardize permit renewal.
Operating in a residential zone (non-ice-cream vendors), within 250 feet of a brick-and-mortar restaurant, or in a city park during concessionaire hours is a violation of LMC § 15.04.050(D)(4). Civil penalty schedule $100 / $200 / $500; permit may be suspended or non-renewed.
