SLMC Title 4 Chapter 4-1 Article 11 §4-1-1115 (Prohibited Acts) declares it unlawful to create 'any noise level caused by use or operation which exceeds the ambient noise level on the premises of any other occupied property … by more than five (5) decibels.' This is the operative industrial-noise rule — measured at the adjoining property line. The Code does not contain numerical decibel limits by zoning district (a fact confirmed by the City's Airport Safety Zone regulations, which explicitly state Chapter 4-1-11 'does not contain numerical noise level limits' and is aimed at abating nuisances). The General Plan Noise Element (Chapter 4.10) supplies the planning-level CNEL/Ldn standards used during CEQA review of new industrial development. §4-1-1115 also independently prohibits sustained operation of any electric or gas-powered motor, engine, automobile/motorcycle repair, sweeper, vacuum, public address, whistle muffler, or mechanical device between 9:00 p.m. and 8:00 a.m. unless enclosed in a sound-insulated structure so that no noise is plainly audible from any residential property line.
Per SLMC §4-1-1130 and Title 1 Chapter 1-12, a first-time infraction is punishable by a fine of up to $100, a second violation of the same section within one year up to $200, and a third or subsequent violation within 12 months may be charged as a misdemeanor. Code Enforcement may also pursue administrative citations and abatement under SLMC Chapter 1-12.
