Whittier Municipal Code Chapter 8.32 applies to commercial and industrial sources through the same general prohibition in WMC 8.32.030 against excessive or unreasonable noise, with the listed factors including the nature and zoning of the area and whether the noise is from a commercial activity. WMC 8.32.040(E) ("Engine-Repair and Testing") specifically makes it unlawful to repair, rebuild, or test any engine so as to create a noise disturbance during nighttime hours. The code contains no numeric dBA limits for industrial zones; enforcement is by audibility and reasonableness (WMC 8.32.060). For relief, WMC 8.32.140 allowed the owner of a commercial or industrial activity that was a source of violating sound to apply, within 90 days of the chapter's effective date, for additional time to comply (the director could grant up to 180 days from the effective date), with appeals to the city manager. Ongoing relief is available through the 30-day waiver process in WMC 8.32.090. Refuse-collection trucks are exempt provided they do not collect between 9 p.m. and 5 a.m. (WMC 8.32.080(H)). Industrial sources may also be subject to conditions imposed through conditional use permits or other development entitlements under the city's zoning code.
