Section 4-10.5 adds a public-entertainment rule: operating any loudspeaker, musical instrument, or other source of sound in a place of public entertainment that exceeds 95 dB(A) at any point normally occupied by a customer is prohibited unless a conspicuous, legible sign states "WARNING! SOUND LEVELS WITHIN MAY CAUSE HEARING IMPAIRMENT" - and that sign never excuses a violation of the 4-10.4 limits or a noise disturbance. Section 4-10.7 exempts recreational programs or activities conducted within City parks between 9:00 a.m. and 10:15 p.m. from the chapter. Outdoor amplified events on private property generally require compliance with the dB(A) standards, and a variance for certain stationary sound sources can be sought from the Zoning Administrator under the Zoning Ordinance. These rules are set by the City of Alameda, not the County.
Violations are infractions under AMC 4-10.12, each day a separate offense, and can be abated as a public nuisance. The Planning or Public Works Department takes measurements under 4-10.8. The 95 dB(A) public-entertainment cap is a distinct prohibition; the warning sign only addresses the hearing-impairment notice, not the underlying neighbor-noise limits.
