Propane and charcoal barbecues are legal in Alameda. Barbecues used solely for cooking are exempt from recreational-fire rules. However, the California Fire Code restricts open-flame and LP-gas grills on or near combustible balconies of apartments and condos unless protected by sprinklers.
Outdoor cooking with barbecues and propane grills is permitted in the City of Alameda. Under the California Fire Code adopted by the City (Alameda Municipal Code Chapter XV, Section 15-1), barbecues, grills, and similar portable devices used solely for cooking are treated as cooking appliances, not as recreational fires or open burning, so the recreational-fire clearance and permit rules do not apply to ordinary grilling. The key restriction applies to multifamily housing: California Fire Code Section 308.1.4 generally prohibits the use or storage of open-flame cooking devices, including charcoal and LP-gas (propane) grills, on combustible balconies or within 10 feet of combustible construction at apartment and condominium buildings, unless the building is protected throughout by an automatic sprinkler system, or the grill is a listed electric device. One- and two-family dwellings are exempt from this balcony restriction. For air quality, the Bay Area Air District does not ban cooking fires even on Spare the Air Alert days, but it recommends using gas or propane grills rather than wood or charcoal during alerts. Grillers should still keep propane cylinders stored outdoors, follow manufacturer instructions, and keep grills a safe distance from siding, eaves, and combustibles.
Using a charcoal or propane grill on a combustible apartment or condo balcony (in a non-sprinklered building) violates California Fire Code Section 308.1.4 and can be cited and ordered removed by the Alameda Fire Department. Single-family home grilling is not restricted by that provision but remains subject to general fire-safety rules.
