CFC 6109 limits residential LP-gas storage to a total of 2 cylinders of 5 gallons each (about 20 lbs per cylinder) for one- and two-family dwellings, and prohibits LP-gas storage in basements, below grade, or on flat rooftops (CFC 6109.13). Hayward Hills, Fairview, and the East Bay foothills east of Mission Boulevard are within designated Local Responsibility Area (LRA) Fire Hazard Severity Zones (Moderate, High, and Very High) under California Government Code 51178, as mapped by CAL FIRE and adopted by the Hayward Fire Marshal. During Red Flag Warnings, the Hayward Fire Marshal may impose total bans on combustion cooking in these zones. Bay Area Air Quality Management District (BAAQMD) Regulation 6, Rule 3 limits wood-burning during Spare the Air alerts - propane and natural gas grills are exempt from those wood-burning alerts.
Violations of the Hayward Fire Code are punishable under CFC 109 with civil penalties up to $1,000 per day. Operating a propane grill on a multifamily balcony triggers fire-marshal correction notices, immediate removal, and administrative citations under HMC 1-7 starting at $100. Operating any combustion grill during a Red Flag Warning in the Hayward Hills FHSZ carries enhanced penalties.
