Outdoor music in Hendersonville is governed by Hendersonville Municipal Code Section 11-403(2), which prohibits any facility within 50 feet of a residence or natural conservation area from operating amplified music outside an enclosed structure except between 7:00 a.m. and 11:00 p.m. City-permitted special events, mass gatherings, and City-owned outdoor entertainment facilities and parks are exempted. Loudspeaker / Loud Noise Permits from the city recorder are required for amplified sound that advertises or attracts attention (Sec. 11-402(1)(k)).
Section 11-403(2) is the operative outdoor-music rule (added by Ord. #2005-13, amended by Ord. #2022-21). Verbatim: 'No person or persons owning, operating, or having the care, custody, or control of any facility located within fifty feet or a residence or of a natural conservation area shall permit to be operated any musical instrument or other entertainment device using amplification unless such music or other entertainment is provided within a totally enclosed structure. Such music or other entertainment may be provided outside of a structure only between the hours of seven a.m. and eleven p.m., except when exempted under provisions of the code as a special event, mass gathering or other permitted activity by the City of its boards or commissions. The provisions of this section shall not apply to entertainment facilities constructed to provide outdoor entertainment owned by the City or its agencies and parks under the control of the board of parks and recreation.' Hendersonville's primary lakefront and downtown event venues include Drakes Creek Park, Memorial Park, Sanders Ferry Park, and Veterans Park, all under the Hendersonville Parks and Recreation Department. City-permitted special events on public property may exceed the 11 p.m. outdoor cutoff if the permit so allows. Private events on commercial or HOA property within 50 feet of a residence (a common geometry in lake-area cul-de-sacs) must end outdoor amplified music by 11 p.m. or move indoors. Loudspeaker/Loud Noise Permits for advertising or attention-attracting amplification require advance application through the city's CSS portal (css.hvilletn.org); the city's stated policy is that a single substantiated noise complaint will revoke an issued permit. Section 11-402(1)(b)'s 11 p.m.-7 a.m. emphasis on amplified sound and Section 11-402(1)(c)'s parallel rule on yelling, shouting, whistling and singing on public streets also apply.
Section 11-403(2) and Section 11-402(1)(k) violations are Title 11 municipal offenses, fined up to $50 per occurrence in City Court under TCA Sec. 6-54-308. A single substantiated complaint also revokes an issued Loudspeaker Permit per the city's stated permit policy.
