Outdoor music in Johns Creek is regulated under the same Section 30-20(a) framework that governs all amplified sound. Section 30-20(a)(1) bars any owner, tenant, or agent at an 'entertainment venue' from using loudspeakers, amplifiers, public address systems, musical instruments, radios, or recorded-music devices to create sound that is 'plainly audible' at a receiving residential property. Where an officer chooses to meter instead, Section 30-20(a)(2), Table 1 sets limits of 55 dBA / 60 dBC daytime and 40 dBA / 50 dBC nighttime, and the meter standard never overrides a plainly-audible finding. Section 30-20(a)(5) exempts a person participating in a parade, athletic event, public assembly, or outdoor special event, provided an administrative permit has been issued where required and the person complies with the permit and city policies, including park-activity policies. Section 30-20(a)(6) exempts emergency signaling and public-safety devices.
Outdoor music that is plainly audible at a home, or exceeds the Table 1 limits, is a nuisance violation. Failure to obey an officer's order to reduce the sound can trigger Section 34-59 (per Section 30-22(e)). Repeat violations carry the Section 30-22(d) progressive fines of $250 / $500 / $1,000, and Section 1-7 allows up to a $1,000 fine and/or six months imprisonment.
