Under UCMC 9.40.043(B), sound performances and special events not exceeding 80 dBA measured at 50 feet are exempt from Chapter 9.40 when approval has been obtained from the appropriate governmental entity, except as provided elsewhere in the Code. Without that approval, outdoor music must stay within the property limits: ambient +10 dBA on residential land (9.40.041), +12 dBA on commercial or industrial land (9.40.042), and +15 dBA on public property at 25 feet (9.40.043(A)). The general daytime exemption (9.40.050) only covers sources under 70 dBA at 25 feet, so amplified outdoor concerts usually need event approval to be lawful.
Unapproved outdoor music exceeding the limits is an infraction under UCMC 9.40.121, each day a separate offense; equipment can be abated as a public nuisance (9.40.122).
