Permitted construction is allowed Monday-Friday 8 a.m. to 8 p.m., Saturday 9 a.m. to 8 p.m., and Sunday/holidays 10 a.m. to 6 p.m., provided equipment stays under the chapter's construction noise caps (UCMC 9.40.053).
UCMC 9.40.053 lets permitted construction, alteration, or repair work proceed during set hours notwithstanding the general noise limits. Allowed hours per the City's Building Division are: Monday-Friday 8 a.m.-8 p.m.; Saturday 9 a.m.-8 p.m.; Sundays and holidays 10 a.m.-6 p.m. To qualify, the work must meet at least one limit: no individual piece of equipment exceeds 83 dBA at 25 feet, or the noise at any point outside the project property plane does not exceed 86 dBA. Work needs a valid City permit. Outside these hours, ordinary noise rules apply and construction noise can be a violation.
Construction outside permitted hours or above the dBA caps loses the 9.40.053 exemption and is an infraction under 9.40.121, with each day a separate offense; abatement as a public nuisance is also available (9.40.122).
