Home barbecuing is allowed in Lincoln as a permitted cooking fire. But under the adopted 2021 International Fire Code, charcoal and LP-gas grills may not be used on combustible balconies or within 10 feet of buildings with three or more dwelling units.
Grilling is an allowed exception under Lincoln Municipal Code 8.06.140, which permits fires in structures such as grills and fireplaces for cooking and warmth, and small cooking fires under eight cubic feet. For apartments and condos, Lincoln's adopted 2021 International Fire Code (LMC 19.03.010) applies IFC 308.1.4: charcoal and LP-gas grills, and LP-gas cylinders over 2.5 pounds, may not be operated or stored on combustible balconies or within 10 feet of a building containing three or more dwelling units. One- and two-family homes are exempt, as are buildings, balconies, and decks protected by an automatic sprinkler system. Single-family backyard grilling has no distance rule beyond avoiding nuisance smoke.
Using a prohibited grill on an apartment balcony violates the adopted International Fire Code (LMC 19.03) and is enforced by Lincoln Fire & Rescue, which may order removal of the device.
