Surprise enforces fire safety through Surprise Fire-Medical Department under Chapter 38 (Fire Prevention and Protection) of the Municipal Code, which adopted the 2018 International Fire Code through Ordinance 2019-21 dated August 6, 2019, with locally adopted amendments to Chapter 12 (Energy Systems). IFC Β§ 308.1.4 prohibits charcoal burners, hibachis, and other open-flame cooking devices on combustible balconies or within 10 feet of combustible construction at apartments, condominiums, and similar multi-family buildings. LP-gas (propane) containers larger than 1 pound are likewise prohibited in those locations. Exceptions apply where the building is fully sprinklered or where the device is electric. The 200-pound aggregate LP-gas capacity cap from IFC Chapter 61 governs total propane stored on a residential site for cooking. For single-family detached homes there is no city restriction on backyard charcoal, propane, or natural-gas grilling. Maricopa County Air Quality Department issues 'No Burn Day' residential wood-burning restrictions during high pollution advisories under Maricopa County Rule 314; these target fireplaces and chimineas, not propane or natural-gas grills. Sun City Grand (The Grand), Sun Village, and other HOAs commonly restrict grill placement on patios and balconies under CC&Rs.
IFC Β§ 308.1.4 violations on multi-family balconies are misdemeanor fire code violations under Surprise Municipal Code Chapter 38 with civil penalties up to $2,500 per day. Surprise Fire-Medical may order immediate removal of prohibited devices. Maricopa County wood-burn violations carry penalties up to $250 per occurrence under Rule 314.
