Surprise has no ordinance specifically regulating residential backyard smokers, pellet grills, or wood-fired ovens. Operation is governed by general nuisance and fire-clearance rules in Chapter 38 (Fire Prevention) of the Municipal Code. Maricopa County 'No Burn Day' advisories under Rule 314 restrict outdoor solid-fuel burning during high pollution advisories. HOAs in Sun City Grand (The Grand) and Marley Park frequently impose stricter limits.
Surprise does not have a smoker-specific ordinance. Wood smokers, pellet grills, offset smokers, and wood-fired pizza ovens are legal on residential property under the Surprise Municipal Code. Surprise Fire-Medical Department requires safe clearance from combustible construction under Chapter 38 adopting the 2018 IFC; recreational fires must be at least 25 feet from any structure or combustible material under IFC Β§ 307.4.2. Persistent dense smoke that materially interferes with a neighbor's use of property can be cited as a public nuisance under Chapter 50 (Nuisances) or general health provisions. Maricopa County Air Quality Department, under Rule 314, declares 'No Burn Day' restrictions during high pollution advisories that restrict outdoor solid-fuel burning including wood and charcoal β propane and natural-gas remain permitted. There is no city permit, decibel limit, or time-of-day limit for residential smokers. For multi-family buildings the same IFC Β§ 308 balcony restrictions as charcoal grills apply β wood/pellet smokers cannot be operated on combustible balconies within 10 feet of combustible construction. HOAs in Sun City Grand (The Grand), Sun Village, Marley Park, and Greer Ranch commonly restrict smoker frequency, placement, and smoke control through CC&Rs. The Arizona Department of Environmental Quality does not regulate residential smokers.
No direct smoker-specific fines under city code. Persistent smoke nuisance complaints can result in Chapter 50 nuisance citations with civil penalties up to $2,500 per day. Maricopa County Rule 314 No Burn Day violations carry fines up to $250 per occurrence. Fire code violations under Chapter 38 follow standard IFC enforcement.
