Gilbert Town Code Chapter 26 adopts the International Fire Code with local amendments enforced by Gilbert Fire and Rescue. IFC Section 308.1.4 prohibits open-flame cooking devices on combustible balconies or within 10 feet of combustible construction at buildings with three or more dwelling units. Exceptions apply where the building, balcony, or deck is protected by an NFPA 13 or 13R automatic sprinkler system or where the balcony is non-combustible. LP-gas containers exceeding 1 pound water capacity may not be stored on or under combustible balconies of multi-family buildings. Solid-fuel devices such as charcoal smokers and wood-burning grills must remain 10 feet from any building. Single-family detached lots have no fire-code clearance for grills. ARS 33-1819 protects a single-family homeowner's right to use a propane grill from HOA prohibition.
Gilbert Fire Code violations under Town Code Chapter 26 carry civil penalties and may escalate to misdemeanor charges for repeat or willful conduct. Multi-family lease violations may trigger eviction proceedings. Fires that damage neighbor property create personal civil liability and may void renter insurance.
