Section 42-316(c) of the Code of Gilbert, part of the Town's community preservation maintenance standards, requires that all fences, screen walls and retaining walls on a property be kept safe, structurally sound, and free of hazard, blight or disrepair, with each continuous run uniform or compatible in material. The section lists leaning fences or walls, missing slats or blocks, rot, damage, graffiti, and peeling or deteriorating paint as examples of the kind of disrepair that violates the standard. Enforcement runs through the same community preservation procedures that cover the rest of Chapter 42, Part 2: under § 42-322, the Town can issue a written notice of violation identifying the problem, setting a reinspection date, and warning that the Town may abate the condition and lien the property if it isn't corrected within 30 days, with an appeal available in writing to the hearing officer within 15 days under § 42-323.
