Between the swimming pool or other contained body of water and the residence or living area, a minimum four foot wall, fence or barrier to the pool area which meets all of the requirements of subsection B, paragraphs 2 through 5. 2. The pool shall be protected by a motorized safety pool cover which requires the operation of a key switch which meets the American society of testing and materials emergency standards 13-89 and which does not require manual operation other than the use of the key switch.
Full Breakdown
The Surprise zoning code establishes fence height limits by location on the property. Front yard fences are limited to 3 feet to maintain neighborhood aesthetics and sight lines. Side and rear yard fences may be up to 6 feet. Corner lots must maintain sight visibility triangles at intersections, typically keeping fences and vegetation below 3 feet within the triangle area. Fences on corner lots along the street-facing side yard follow front yard height limits. Fences do not require a building permit in most cases unless they exceed height limits or include masonry construction. Many Surprise master-planned communities (Marley Park, Surprise Farms, Asante) have CC&Rs specifying fence materials, colors, and heights. HOA architectural review may be required before installation. Contact Community Development at (623) 222-1200.
Violations & Fines
Fences exceeding height limits without a variance receive code enforcement citations. Corner lot sight triangle violations are safety issues requiring prompt correction. HOA violations are enforced separately through the association.
